Maintained country rule

Section 101 of jätelaki (646/2011) requires the producer, the producer organisation or the deposit-return operator to apply to Lupa- ja valvontavirasto for approval into the producer register under section 142(1)(3), in good time so that waste management of the discarded products can be secured. Finland does not phrase this as a ban on placing equipment on the market; the nearest equivalent is section 55, which requires the producer to tell its distributor that it belongs to the register and requires distributors, other businesses and public purchasers to make sure so far as possible that the producer of the product supplied to them is in the register. The sector decree is valtioneuvoston asetus 519/2014. Directive 2012/19/EU Article 2(4)(g) excludes devices expected to be infective before end of life and active implantable devices; other medical devices are in scope, and Article 16 requires each Member State to keep a producer register.
