France runs one national producer register across all extended-producer-responsibility streams. ADEME, which operates it, states that the identifiant unique is proof that the producer is registered in the SYDEREP declarative system for a given stream, under article L. 541-10-13 of the Code de l'environnement in force since 1 January 2022. The French mechanism is disclosure-based rather than a market bar: the identifiant must appear in the general terms of sale and be given to buyers on request, and online marketplaces must check that their sellers hold one. Whether any provision bars placing on the market outright was not verified, because Légifrance is unreachable. Directive 2012/19/EU Article 2(4)(g) excludes devices expected to be infective before end of life and active implantable devices; other medical devices are in scope, and Article 16 requires each Member State to keep a producer register.
