Italy is among the first Member States with a full national adaptation in force: decreto legislativo 10 February 2026 n. 29, published 6 March 2026 under the 2024 European delegation law. Article 20 establishes the register of battery producers required by Article 55 of the Regulation as a supply-chain register inside the national producer register under article 178-ter(8) of decreto legislativo 152/2006, replaces the old battery register under decreto legislativo 188/2008, has the chambers of commerce collect the data, and obliges producers making batteries available on the national market for the first time — including batteries in appliances, light means of transport or other vehicles — or their authorised representatives for extended producer responsibility, to apply electronically to enrol with the competent chamber of commerce. Article 11(2)(b) of Regulation (EU) 2023/1542 lets professional medical imaging and radiotherapy devices and in vitro diagnostic medical devices restrict portable-battery replacement to independent professionals, and Article 11(3) lifts the removability duty where continuity of supply is needed for safety or data integrity.
