Article 50(1)(4)(a) of the waste act puts those placing batteries and accumulators on the market into the same register as WEEE producers, so the article 50(2) and (3) pre-activity gate applies to them too. A search of the Sejm ELI database returned no Polish act implementing Regulation (EU) 2023/1542; the operative national instrument is still the battery act of 24 April 2009, consolidated at Dz.U. 2025 poz. 809, which implements the repealed Directive 2006/66/EC, and the Regulation applies directly alongside it. Whether Poland has formally designated the BDO register as the Article 55 register was not confirmed. Article 11(2)(b) of Regulation (EU) 2023/1542 lets professional medical imaging and radiotherapy devices and in vitro diagnostic medical devices restrict portable-battery replacement to independent professionals, and Article 11(3) lifts the removability duty where continuity of supply is needed for safety or data integrity.
