Décret n° 2023-2419, art. 36: "L'importation de tout dispositif médical, quelle que soit sa classe d'appartenance est subordonnée à une autorisation préalable de la structure en charge de la Réglementation pharmaceutique", a rule the ARP arrêté repeats in its art. 25 for every medical device. The import authorisation is separate from the marketing authorisation — the décret lets the ARP withdraw, suspend or cancel it on a reasoned decision (art. 37) — and the conditions for granting it are fixed by arrêté of the Minister of Health.
