No Spanish instrument implementing Regulation (EU) 2023/1542 is in force and no Article 55 register has been designated. MITECO has a proyecto de real decreto sobre las pilas y baterías y la gestión de sus residuos in public consultation, stated to close on 3 September 2026, whose purpose is to secure application of the Regulation in Spain. Until it is adopted the operative rules are the directly applicable Regulation plus Real Decreto 106/2008 as amended by Real Decreto 710/2015, whose first additional provision keeps battery producers enrolled in the industry register now called RII-PYA, operated by the Ministerio de Industria y Turismo. Because the consultation closes on that date, the BOE should be re-checked shortly afterwards. Article 11(2)(b) of Regulation (EU) 2023/1542 lets professional medical imaging and radiotherapy devices and in vitro diagnostic medical devices restrict portable-battery replacement to independent professionals, and Article 11(3) lifts the removability duty where continuity of supply is needed for safety or data integrity.
