Article 43(4) of the Law of Georgia on Electronic Communications forbids the use of the radio-frequency spectrum or of numbering resources without the authorisation, licence or right to use a scarce resource obtained in the electronic-communications field. Article 47(4) makes the allocation and regulation of the radio spectrum a competence of the Commission, and Article 47(6) provides that the spectrum-use right is acquired by licence, auction or contest. This is a use-site condition on the operator, distinct from the equipment certification above.
