Article 18 of the Regeling afgedankte elektrische en elektronische apparatuur puts the Stichting Nationaal (W)EEE Register in Zoetermeer in charge of setting up and running the register required by Article 16(1) of Directive 2012/19/EU, and Article 19(1) requires a producer to report itself to that register. That is a bare duty to register rather than a condition precedent to placing equipment on the market. In practice producers register through Stichting OPEN, because the waste-management contribution agreement has been declared universally binding. Directive 2012/19/EU Article 2(4)(g) excludes devices expected to be infective before end of life and active implantable devices; other medical devices are in scope, and Article 16 requires each Member State to keep a producer register.
