CE marking under the Union regulations is the domestic route; no separate Latvian approval decision

reliance.eu-ce-marking-is-the-domestic-route
Fact-level verified
Statement

A CE mark under Regulation (EU) 2017/745 (or 2017/746 for IVDs) is the domestic route into Latvia and is valid throughout the EU/EEA. Once the Latvian notification procedure is complete, the notifier is entitled to place the device on the Latvian market without any decision or approval of the State Agency of Medicines; the agency publishes the notification data and the procedure is then deemed complete. What remains are local obligations: a manufacturer without an EU establishment must designate a sole authorised representative, and a distributor established in Latvia must be entered in the LATMED database before making devices available.

  • The agency checks the submitted declaration of conformity and notified-body certificates against the national regulation, Regulation (EU) 2017/745 and directly applicable EU acts, and may require corrections or translations (MK noteikumi Nr. 461 paragraphs 10 and 16).
  • Manufacturers not established in a Member State may place a device on the Union market only if they designate a sole authorised representative (source res-lv-mdr, Article 11(1)).
  • Distributors established in Latvia may make devices available on the Latvian market only if information about them is entered in the LATMED database (MK noteikumi Nr. 461 paragraph 41.1).

Notes
  • Latvia operates no national device authorisation, so there is no authorisation fee: the fee record consists of the State Agency of Medicines charges for the acts it performs under Cabinet Regulation No. 461, plus the State Environmental Service radiation registration and licence state fees.
  • The device schedule is only partly differentiated by device risk class. The recurring annual vigilance-system fee is the one line that tracks the class axis exactly: EUR 105.20 for class I and other (remaining) medical devices and class A IVDs (item 62.1) against EUR 201.90 for class IIa, IIb and III devices and A-list, B-list and self-test, class B, C and D IVDs (item 62.2), payable per manufacturer, authorised representative or distributor. Every other line is a class-independent charge for a certificate, an expert examination or a consultation.
  • The two bands are the reporter's grouping of the published amounts: the lower band collects the recurring class I / A-class IVD vigilance fee and the free-sale certificate available to a manufacturer of any class; the upper band collects the recurring IIa/IIb/III vigilance fee and the class-independent expert charges (EUR 528.60 for placing a non-CE-marked device on the market, EUR 900 and EUR 1,500 for clinical-investigation documentation, EUR 1,200 for a cost-effectiveness expertise and EUR 2,000 for a classification and clinical-evaluation consultation). The radiation state fees sit on a separate, non-risk-class axis and are outside both bands.
  • Footnote 1 to the schedule's annex states that value added tax is not applied, under section 3(8) of the Value Added Tax Law, so every amount in this record is net of VAT.
  • The schedule was adopted on 18 December 2024 and took effect on 1 January 2025; the medical-device lines read here are items 8.1, 54, 55, 56, 57, 61, 62.1, 62.2 and 63 of the annex, and no device line was found in the schedule that is not published in this record.
  • The radiation state fees are the amounts in § 63 of Cabinet Regulation No. 65: EUR 97 for a registration certificate, EUR 170 for a licence, EUR 54 for changes to a registration certificate, EUR 84 for amendments to a licence and EUR 10 for the changes listed in § 64. They are payable before the application is submitted.

    Object

    Electrical Medical Equipment

    Note

Annex II of Directive 2014/35/EU places electrical equipment for radiology and medical purposes outside the Low Voltage Directive, so no separate Latvian electrical-safety certificate exists for a medical device; electrical safety is assessed inside the MDR conformity assessment against MDR Annex I, with the harmonised IEC/EN 60601 series carrying the presumption of conformity. The Latvian instrument transposing the Low Voltage Directive for standalone equipment was not retrieved, so this row is bound to the Union directive.

    Note

Article 2(3) of Directive 2014/30/EU switches the EMC Directive off where other Union legislation lays the same essential requirements down more specifically, which MDR Annex I sections 18.5 and 18.6 do for medical devices. EMC is therefore dossier evidence inside the CE route rather than a separate Latvian conformity step; where a device is also radio equipment, § 1.1 of Cabinet Regulation No. 215 brings it within the Latvian radio-equipment conformity-assessment and surveillance regime. The Latvian instrument transposing the EMC Directive for standalone equipment was not retrieved, so this row is bound to the Union directive.

Radioiekārtu atbilstības novērtēšanas, piedāvāšanas tirgū, uzstādīšanas, lietošanas un uzraudzības noteikumi, Cabinet Regulation No. 215 of 02.04.2024, in force 11.04.2024, is made under Article 7 of the law 'Par atbildības novērtēšanu' and Article 33(2) of the Electronic Communications Law. It states the requirements for placing radio equipment on the market, for its installation and use, the market-surveillance procedure and the conformity-assessment procedure. § 2 provides verbatim that 'Radioiekārtu tirgus uzraudzību veic Patērētāju tiesību aizsardzības centrs, kas šo noteikumu izpratnē ir tirgus uzraudzības iestāde', and § 3, as amended by Cabinet Regulation No. 733 of 09.12.2025, that 'Radioiekārtu lietošanas uzraudzību veic sabiedrība ar ierobežotu atbildību "Elektroniskie sakari", kas šo noteikumu izpratnē ir lietošanas uzraudzības institūcija'. A medical device that is also radio equipment therefore carries these requirements in addition to the MDR route. The Latvian radio-equipment market-surveillance authority is PTAC, not the electronic-communications regulator and not the health inspectorate.

    Legal Measuring Instruments

    Note

Under the law 'Par mērījumu vienotību' of 27.02.1997 the state metrological control of measuring instruments consists of conformity assessment or type approval together with initial verification, the repeated verification of instruments in use, and state metrological supervision, which PTAC's own page states verbatim is 'valsts metroloģiskā uzraudzība, kuru pilnvarots veikt Patērētāju tiesību aizsardzības centrs'. Cabinet Regulation No. 289 of 14.05.2024, in force 15.07.2024, made under Article 7(2) of that law, sets the list of measuring instruments subject to state metrological control together with their initial verification and the periodicity of repeated verification. A medical device that is a legal measuring instrument (for example a sphygmomanometer or a clinical thermometer used in a regulated measurement) therefore carries its own Latvian metrological duty; the CE marking on a medical device does not discharge it. No Latvian fee amount for type approval or verification was retrieved.

Darbību ar jonizējošā starojuma avotiem paziņošanas, reģistrēšanas un licencēšanas noteikumi, Cabinet Regulation No. 65 of 28.01.2021, in force 01.02.2021, is made under Article 5(12), Article 11(4) and (7), Article 12(2) and Article 13 of the law 'Par radiācijas drošību un kodoldrošību'. It splits activities with ionizing radiation sources into notifiable, registrable and licensable activities and requires the operator to hold whichever instrument its activity falls under. § 13.3 names the competent body verbatim as 'Valsts vides dienesta Radiācijas drošības centrs (turpmāk – centrs)'. § 62 requires the state fee to be paid before the application is submitted, by bank transfer or through the payment module in the State Environmental Service information system, and § 63 fixes the amounts: EUR 97 for a registration certificate, EUR 170 for a licence, EUR 54 for changes to a registration certificate, EUR 84 for amendments to a licence and EUR 10 for the changes listed in § 64. A medical device that produces ionizing radiation (an X-ray unit, a CT scanner, an accelerator) is in scope at the site where it is used, in addition to the MDR route and the device's own CE marking.

Elektrisko un elektronisko iekārtu un bateriju vai akumulatoru ražotāju reģistrācijas kārtība un samaksas kārtība par datu uzturēšanu, Cabinet Regulation No. 331 of 17.06.2014, in force 01.07.2014 (as amended by Cabinet Regulation No. 227 of 28.04.2026), is made under Article 24(2) and (4) and Article 31(3) and (4) of the Waste Management Law. § 7 requires a producer of electrical and electronic equipment to submit a registration application (Annex 1) to the registrar together with a document evidencing the advance payment referred to in § 37.1, and to be registered in the equipment producer register, which the registrar maintains; § 7.1 imposes the same on an authorised representative of a foreign producer within one month of being authorised; § 8 requires the documents for each foreign producer represented and a separate payment for each. § 22 requires a producer of batteries to submit a registration application (Annex 1.2) together with the advance payment referred to in § 37.2, the authorised representative's route being in § 23, framed by Article 56(3) of Regulation (EU) 2023/1542. The duty is therefore a producer obligation attaching to placing electrical and electronic equipment and batteries on the Latvian market. The data-maintenance payment is fixed in § 37: EUR 42.69 on registration and EUR 42.69 for each subsequent calendar year for equipment producers (§ 37.1) and the same amounts for battery producers (§ 37.2).
